INTERNATIONAL TRAFFIC IN ARMS REGULATIONS (ITAR) DISCLOSURE & EXPORT CONTROL POLICY

1. Export Control Notice & Compliance Acknowledgment

Certain items, products, software, and technical data offered for sale on this website are strictly controlled by the U.S. Department of State under the International Traffic in Arms Regulations (ITAR) (22 C.F.R. Parts 120–130) or the U.S. Department of Commerce under the Export Administration Regulations (EAR) (15 C.F.R. Parts 730–774).

By placing an order, browsing, or purchasing any export-controlled item from AeonTac Night Vision, you explicitly acknowledge, represent, and warrant that you understand and agree to adhere to all applicable U.S. export control laws and regulations.

2. Customer Eligibility & U.S. Person Status Requirements

Under ITAR, controlled products, technical data, and defense services may ONLY be purchased, accessed, or received by individuals or entities who qualify as a “U.S. Person” as defined under 22 C.F.R. § 120.62.

By initiating a purchase of an ITAR-controlled item on this website, you certify under penalty of perjury that:

  • You are a U.S. Citizen, a Lawful Permanent Resident (Green Card holder), or a Protected Individual under U.S. immigration laws (22 U.S.C. 2778).

  • You are NOT a Foreign Person, non-permanent resident alien, foreign corporation, or representative/agent of a foreign government.

  • You will not grant any non-U.S. Person access to ITAR-controlled products, physical components, or associated technical data without prior written authorization from the U.S. Department of State Directorate of Defense Trade Controls (DDTC).

3. Prohibition on Unlawful Export & Resale

  • No International Shipping: ITAR-controlled products listed on this site will NEVER be shipped to addresses outside the 50 United States or U.S. territories. Orders addressed to international destinations, freight forwarders, APO/FPO/DPO addresses, or diplomatic pouches are strictly prohibited and subject to immediate cancellation.

  • No Resale/Diversion to Foreign Persons: You agree that you will not export, re-export, resell, transfer, redirect, or disclose any ITAR-controlled item or technical data—directly or indirectly—to any foreign national, foreign country, or foreign entity without obtaining the appropriate prior export license or written approval from the U.S. Government.

4. Identity Verification & End-User Certification

To ensure strict compliance with U.S. federal laws:

  • AeonTac Night Vision reserves the right to require identity verification, including proof of U.S. citizenship or lawful permanent residency (e.g., driver’s license, U.S. passport, or Green Card), prior to processing or shipping any order containing controlled items.

  • AeonTac Night Vision may require buyers to complete and execute a signed End-User Statement / ITAR Certification Form affirming the lawful identity of the purchaser and the intended domestic end-use of the product.

  • AeonTac Night Vision reserves the absolute right to cancel any order or refuse service if buyer eligibility or compliance cannot be verified to our satisfaction.

5. Severe Legal Penalties for Non-Compliance

Violations of the International Traffic in Arms Regulations (ITAR) are severe federal offenses. Unlawful export or disclosure of ITAR-controlled items or technical data can result in severe civil penalties exceeding $1,200,000 per violation, criminal fines up to $1,000,000 per violation, and imprisonment for up to 20 years. AeonTac Night Vision actively cooperates with federal law enforcement agencies, including the Department of Homeland Security (HSI) and the FBI, to report suspicious orders or suspected illegal export attempts.

CALIFORNIA PROPOSITION 65 NOTICE & COMPLIANCE POLICY

1. General Proposition 65 Notice

In accordance with the California Safe Drinking Water and Toxic Enforcement Act of 1986 (commonly known as Proposition 65), AeonTac Night Vision provides warnings to consumers in the State of California regarding potential exposures to chemicals listed by the State of California as causing cancer, birth defects, or other reproductive harm.

Proposition 65 requires any business selling products to California residents to provide a “clear and reasonable warning” before exposing purchasers to any of over 900+ listed chemicals, even when exposure levels are well within federal safety standards.

2. Applicable Product Warnings

Products sold by AeonTac Night Vision—including night vision housings, optical lenses, metallic components, mounting hardware, synthetic materials, coated items, or electronic accessories—may contain trace amounts of chemicals listed under Proposition 65. Depending on the specific item ordered, one or more of the following warnings applies:

WARNING: This product can expose you to chemicals including lead, nickel, or phthalates, which are known to the State of California to cause cancer and birth defects or other reproductive harm. For more information, go to www.P65Warnings.ca.gov.

3. Internet & Catalog Sale Compliance Requirement

Under California Office of Environmental Health Hazard Assessment (OEHHA) regulations (27 CCR § 25602), providing a Proposition 65 statement solely within the site’s Terms and Conditions is not sufficient for online orders shipped to California.

By placing an order for shipment to a California address with AeonTac Night Vision, you acknowledge that:

  • You have been provided with the required Proposition 65 warning prior to product purchase.

  • Product-specific Prop 65 warnings are displayed on the relevant product listing pages or presented dynamically during the checkout process prior to order completion.

4. Manufacturer Information & Inquiries

AeonTac Night Vision sources products and components from certified manufacturers and suppliers. If you have specific questions regarding chemical disclosures or Prop 65 warnings for a particular product offered on our site, please contact customer support at support@aeontacnightvision.com prior to placing your order.

Refunds & Returns Policy

Complete Night Vision Devices:

AeonTac offers purchasers of complete night vision devices a THREE DAY (3 days) INSPECTION PERIOD. If, for any reason, you are not satisfied with your Night Vision Device purchase, you may return it for a FULL REFUND, less shipping costs. Terms:

  1. Your inspection period begins on the date your purchase is marked “DELIVERED” by the shipper, and ends at 5pm Pacific Standard Time on the third day after being so marked
  2. You MUST notify AeonTac Night Vision in writing of your intent to exercise this option before the period elapses, by emailing support@aeontacnightvision.com
  3. You must include your name, delivery address, order number and reason for return.
  4. The above being completed, you will be notified by email of acceptance of your return, and issued an RMA number, as well as a prepaid return shipping label, within 3 business days
  5. Once your complete nightvision device is received back at our facility, it will be inspected. Damage, missing parts or components, Non-OEM parts, etc will result in a DENIAL of your refund. NO PRORATIONS or ADJUSTMENTS will be accepted

Intensifier Tubes:

All sales of intensifier tubes are FINAL. If you find your intensifier tube is damaged, non-functional, or has operating issues, you must submit a WARRANTY CLAIM by emailing support@aeontacnightvision.com

Parts, Accessories, Other

AeonTac Night Vision offers a 30-day return or exchange policy on all Parts, Accessories, other.

Terms:

  1. Your Return / Exchange period begins on the date your purchase is marked “DELIVERED” by the shipper, and ends at 5pm Pacific Standard Time on the thirtieth day after being so marked
  2. You MUST notify AeonTac Night Vision in writing of your intent to exercise this option before the period elapses, by emailing support@aeontacnightvision.com
  3. You must include your name, delivery address, order number, and reason for return or request for an exchange
  4. The above being completed, you will be notified by email of acceptance of your return, and issued an RMA number, within 3 business days.
  5. YOU are responsible for return shipping

The execution of ANY purchase from this e-commerce site constitutes acceptance of these terms & conditions.
